Welcome Video: Miguel Fernandez

I’m Miguel Fernandez and my law office is located in downtown Fort Myers. Since 1990, I’ve been representing individuals with their DUI and criminal defense cases. Today, I want to talk to you about DUI stops, because we’re seeing more and more aggressive law enforcement investigations and prosecutions in this regard. DUI or impaired driving cases are not limited to just alcohol. They can also be triggered by the use of controlled substances, medications, or a mixture of [inaudible 00:00:35]. If you find yourself being investigated for a DUI, be aware that your interaction with the police is likely being recorded by body cams, dash cams, rear seat cams in squad cars, so at all times be careful what you say and how you say it.

Also remember you are not required to perform field sobriety exercises and often your submission and performance of these will never satisfy police. If you are arrested, insist on speaking with a lawyer before answering any of their questions. Invoke your right to remain silent. You should also know that you can not be forced to take a breath test, but your refusal to take one after your arrest will result in either a 12-month or 18-month administrative suspension of your license. Then, you only have up to 10 days from the date of your arrest to apply for a formal review hearing and temporary permit to fight the suspension of your license. I am Miguel Fernandez. I encourage you to call my office at 239-337-0123 so we can fight for your rights and defend your interests should you be facing a DUI charge.
